DRI files amicus curiae brief on the group violence in Samtredia

On September 11, 2019 the Democracy Research Institute filed an amicus curiae brief to the Samtredia District Court, regarding alleged group violence based on the victim’s ethnic origin and religion with the reason of intolerance. 

In the amicus brief, the Democracy Research Institute noted that the State is obliged to swiftly and effectively investigate crimes committed on the basis of hate or intolerance. 

The document expresses, that the not only the crimes committed because of perpetrator’s intolerance towards victim are qualified as ,,hate crime’’ but also the crimes when perpetrator's motives were mixed, should be considered as such.   

In DRI’s opinion, the severe and disproportionate form of violence, that was used towards the person unknown to the perpetrators, in correlation with the words spoken, by the defendants emphasizing that they could not tolerate insults because of the victim’s ethnic origin and religion, might directly indicate the reason for intolerance.

Democracy Research Institute hopes that the brief will be helpful for the court to produce a legitimate, reasoned and fair judgment, that will contribute to preventing hate crimes.
