Democracy Research Institute assesses situation of those arrested during the protests against the Russian law

Georgian Dream adopted the Russian law, which restricts free and critical opinions in Georgia. The law blocks the path of the people of Georgia to the European Union.

The Democracy Research Institute defends the interests of Omar Okribelashvili and Saba Meparishvili, who were detained during the protests against the Russian law. The Prosecutor's Office of Georgia accuses the detainees of damaging the temporary iron structure in front of the Parliament of Georgia.

The moment of arrest - The evidence in the case proves that during the arrest Saba Meparishvili was severely beaten by the employees of the Ministry of Internal Affairs, as a result of which he received injuries on his face and both legs. Both detainees became victims of abuse, psychological and physical violence. They were not given the opportunity to exercise their right of defence, as a result of which, fearing violence, they signed documents at the police station, the content of which was unknown to them. Employees of the Ministry of Internal Affairs forced Omar Okribelashvili's father to come to the Central Criminal Police building and sign a testimony against his son. According to the Criminal Procedure Code, every person has the right to refuse to testify against a family member, although this right was not explained to the father of the detainee.

Pre-trial detention - Omar Okribelashvili and Saba Meparishvili are charged with damaging property (subparagraph "c" of part 2 of Article 187 of the Civil Code). The Prosecutor's Office of Georgia accuses the detainees of damaging the iron dam in front of the Parliament and causing damage to the state in the amount of GEL 400. Despite the small amount of the damage to be reimbursed, Tbilisi City Court judge Davit Kurtanidze ordered pretrial detention for the detainees.

According to the Democracy Research Institute, the article of the Criminal Code, on the basis of which the investigation is being conducted, is problematic. DRI applied to the Constitutional Court in March 2024 with the request to declare the said norm unconstitutional. The organization considers that the normative content of subparagraph "c" of part 2 of Article 187 of the Criminal Code (damaging or destroying another's person’s property, committed in a group) and the non-alternative punishment provided for it (imprisonment for a period of 3 to 6 years) are inconsistent with the Constitution of Georgia, in particular , with the right to dignity and equality.

Pretrial detention conditions - Omar Okribelashvili and Saba Meparishvili are placed in the Gldani penitentiary facility. According to the detainees, before the visit of the lawyers and representatives of the Public Defender, they had to stay in hellish conditions in the cell. The hostile environment created for them in the cell was related to their participation in protests. As of now, after the visit of the lawyers and representatives of the Public Defender, the condition of the detainees has improved.
